Terms of Service

1. Definitions
"Service" refers to the NodeBar platform, including APIs, data, features, and documentation. "User" refers to any individual or entity accessing the Service. "Data" includes market data, derived features, analytics, and outputs provided through the API.
NodeBar is the continuation of the same service previously operated by the same provider under a different trading name and domain. All existing accounts, subscriptions and API keys remain valid under these Terms.
2. Eligibility and Business Use
The Service is intended solely for professional and business use. By using the Service, you confirm that you are acting in a business or professional capacity and that you are at least 18 years old. The Service is not directed to persons under 14 years of age, the minimum age for valid consent under Spanish law (LOPDGDD Art. 7).
If, despite the business-only nature of the Service, you access it as a consumer within the meaning of EU consumer law, the mandatory provisions of consumer law of your country of habitual residence will apply to the extent they grant you greater protection than these Terms.
3. Account and API Keys
- You are responsible for all activity under your account.
- API keys must be kept secure and confidential.
- Sharing API credentials is strictly prohibited.
- You must notify us immediately of unauthorized access.
4. License and Permitted Use
Subject to these Terms, NodeBar grants you a limited, non-exclusive, non-transferable license to use the Service and Data for internal business purposes.
- Use in trading systems, analytics, and internal tools is permitted.
- Storage of processed outputs is allowed.
- Use for model training is permitted.
5. Prohibited Use
- No redistribution, resale, or sublicensing of raw data.
- No use to build competing data services.
- No circumvention of rate limits or quotas.
- No reverse engineering of API infrastructure.
- No abusive or excessive automated requests.
6. Third-Party Data and Sources
Certain data provided through the Service originates from third-party providers, including:
- Market data: OHLCV price data for equities, FX, crypto, ETFs and commodities from licensed data providers.
- World Bank: Macro economic indicators (GDP, CPI, unemployment, etc.) under CC BY 4.0 license.
- Eurostat: EU economic statistics (HICP, employment, HPI, etc.) under CC BY 4.0 license.
All outputs are derived features (indicators, z-scores, regime states, composites), never raw data replication. Availability, accuracy, and historical coverage may vary and are not guaranteed.
7. API Limits and Fair Use
Usage is subject to rate limits and quotas based on your subscription tier. We reserve the right to throttle or suspend usage that negatively impacts system stability.
8. Fees and Billing
- Subscriptions are billed in advance on a recurring basis.
- All payments are processed via Stripe.
- Fees are non-refundable except where required by law.
- Failure to pay may result in suspension or termination.
9. Suspension and Termination
We may suspend or terminate access immediately if:
- You violate these Terms.
- There is suspected abuse or fraud.
- Payment fails or is disputed.
10. Intellectual Property
All rights, title, and interest in the Service and Data remain with NodeBar and its licensors.
11. No Investment Advice
The Service does not provide investment, financial, legal, or tax advice. All data and features are provided for informational and analytical purposes only.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, including accuracy, completeness, or availability.
13. Limitation of Liability
To the maximum extent permitted by law, NodeBar shall not be liable for any indirect, incidental, or consequential damages, including trading losses or loss of profits.
Total liability shall not exceed the amount paid by the user in the previous 12 months.
14. Indemnification
You agree to indemnify and hold harmless NodeBar from any claims arising from misuse of the Service or violation of these Terms.
15. Changes to the Service
We may modify, update, or discontinue any part of the Service at any time without prior notice.
16. Changes to Terms
We reserve the right to update these Terms. Continued use of the Service constitutes acceptance of the updated Terms.
17. Governing Law and Jurisdiction
These Terms shall be governed by the laws of Spain. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts and tribunals of Madrid (Spain).
Notwithstanding the foregoing, if you access the Service as a consumer within the meaning of EU consumer law, the mandatory consumer-protection rules of your country of habitual residence shall continue to apply, and you may also bring proceedings before the courts of that country.
